We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. Accuracy of Information

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

3. Personalised Products & Customer Responsibility

As we specialise in custom print items and personalised gifts, specific terms apply to these orders:

  • Accuracy: You are solely responsible for ensuring that all personalisation details (spelling, dates, grammar, punctuation, and image quality) are correct at the time of ordering. We print exactly what is submitted. We do not proofread or edit your submission.

  • Errors: We cannot offer refunds or replacements for items where the error was made by the customer (e.g., a misspelled name or a low-quality photo upload).

  • Colour Variations: Please note that colours on physical printed products (stickers, cards, wrapping paper) may vary slightly from what you see on your digital screen due to different monitor calibrations.

4. Food Safety & Allergen Information

We sell sweet treats, sweet cones, and party boxes containing food items.

  • Ingredients: All food items come with ingredient labels or information available upon request. It is your responsibility to check these labels upon receipt.

  • Allergies: Please be aware that our products are packed in an environment that handles nuts, dairy, gluten, soy, and eggs. We cannot guarantee that any product is 100% free from cross-contamination of allergens. If the recipient has a severe allergy, we recommend you contact us prior to purchasing.

  • Shelf Life: As these are perishable goods, they should be consumed within the timeframe suggested on the packaging (usually best consumed within 4-6 weeks for freshness).

5. Returns and Refunds

Our policy aligns with the UK Consumer Contracts Regulations 2013, specifically regarding the exemption for custom-made and perishable goods.

  • Exemptions: We do not accept returns or cancellations for "change of mind" on personalised items or perishable food goods once the order has been processed.

  • Damaged/Faulty Goods: In the unlikely event that your order arrives damaged, or we have made an error in the personalisation (that differs from what you submitted), please contact us within 48 hours of delivery. You must provide a photograph of the issue. We will arrange a replacement or refund in accordance with your statutory rights.

6. Shipping and Delivery

  • Processing vs. Shipping: Please distinguish between "processing time" (the time it takes us to create/pack your custom order) and "shipping time" (the time it takes the courier to deliver it).

  • Delays: We are not liable for delays caused by the courier (e.g., Royal Mail strikes, adverse weather) once the item has been dispatched from our premises.

7. Limitation of Liability

To the extent permitted by law, Hoopsy Personalised shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales.
